Privacy Notice in Recruitment Processes of Valérius-Têxteis, S.A.
Valérius-Têxteis, S.A. is committed to ensuring the security and privacy of your personal data. This document aims to provide information to candidates in the selection and recruitment processes of Valérius-Têxteis, S.A. regarding the processing of personal data that concerns them, as well as the privacy and security practices adopted, with the goal of demonstrating its commitment and respect for privacy and the protection of personal data collected and processed in compliance with data protection legislation.
1. Scope
This Privacy Notice applies exclusively to the collection and processing of personal data carried out by Valérius-Têxteis, S.A. in the context of the recruitment and selection process for hiring employees. The processing of data is necessary to carry out all stages of the recruitment process as long as the data subject intends to apply for the recruitment.
This applies to all applications, whether spontaneous or in response to specific recruitment processes.
It also applies to applications submitted in paper format, when addressed to the Human Resources Department of Valérius-Têxteis, S.A., responsible for recruitment processes.
It applies to any other personal data the candidate provides, in any form, to us or to the entity designated to intervene in the recruitment and selection process.
Valérius-Têxteis, S.A. may also collect information concerning the candidate from publicly accessible sources, public bodies, and contacts provided by the candidate, to complement and/or confirm the information provided in the recruitment and selection process.
2. Personal Data
Personal data refers to information of any nature and format, including sound and image, related to an identified or identifiable individual. A person is considered identifiable if they can be identified, directly or indirectly, especially by reference to an identification number or to one or more specific elements of their physical, physiological, psychological, economic, cultural, or social identity.
2.1. Identification of the Data Controller
Valérius-Têxteis, S.A. is the entity responsible for collecting and processing the Personal Data of Candidates, and in this context, decides which data is collected, the means of processing, and the purposes for which the data is processed.
2.2. What data do we collect?
Name, Address, Phone and Email Contact, Professional Experience, Educational Qualifications, Citizen Card Number, Tax Identification Number, Age, and other details provided in the application form to be filled out by the Candidate. We may also collect personal data through third parties, such as specialized recruitment agencies, references, previous employers, employment background checks, as permitted by law.
2.3. Purposes of processing
The Personal Data collected will be processed for the purposes of selecting and recruiting the Candidate and, if selected, integrating them into the workforce of Valérius-Têxteis, S.A. as part of an employment and/or internship relationship. If the Candidate is not selected for the position they applied for, the collected personal data will be considered, with the Candidate's consent, for future vacancies that may arise and match the Candidate's profile.
2.4. Legal basis for processing, according to Article 6 of the GDPR
- Processing necessary for the performance of a contract to which the data subject is a party, or for pre-contractual steps at the request of the data subject;
- Consent of the data subject.
2.5. Retention period
The aforementioned Personal Data may be retained by Valérius-Têxteis, S.A. for the time necessary to fulfill the purposes mentioned above:
• For a maximum of one year from (i) the submission of the application through which the data was provided, in the case of a spontaneous application, and if the Candidate has not been part of any recruitment process of Valérius-Têxteis, S.A. during that period;
• For a maximum of five years from (ii) the completion of the recruitment process in which the data was collected, if the candidate was not hired, in order to integrate them into other recruitment processes that may be created and fit the candidate’s profile and capabilities;
• When based on consent, data will be kept for a period of five years or until the moment the data subject withdraws their consent.
2.6. Who do we share your data with?
The Personal Data of Candidates may be processed by other entities to whom Valérius-Têxteis, S.A. has subcontracted the processing, namely specialized recruitment companies and temporary work agencies, hired to assess and select applications, conduct interviews, verify qualifications, or other candidate data.
2.7. What are your rights?
The Candidate has the right to request, in writing, to the Human Resources Manager, by contacting rgpd@valerius.pt or in person by filling out the Personal Data Subject Rights Exercise Form:
• Access, under the terms and conditions legally provided, to the Personal Data that concern them and are subject to processing;
• Correction or updating of inaccurate or outdated Personal Data that concerns them;
• Processing of incomplete Personal Data when such data is found to be missing;
• Deletion, in cases specifically provided for by law, of Personal Data that concerns them;
• Limitation, under the conditions specified by law, of the processing of Personal Data concerning them;
• Withdrawal of consent given, when the processing of data is based solely on consent;
• Objecting to processing for reasons related to their particular situation, when the processing of data is based on the legitimate interest of the data controller or a third party;
The candidate can also request more detailed information, namely regarding the purposes, legal grounds, retention periods, and can also file complaints about how their Personal Data is processed, without prejudice to doing so with the National Data Protection Commission (CNPD) – Address: Av. • Some data requested from the candidate during the recruitment process may be a mandatory requirement for evaluating the application for certain positions, so, if applicable, Valérius-Têxteis, S.A. will inform the candidate that if these data are not provided, the application cannot be processed;
• Receive the personal data concerning them that have been provided to a data controller, in a structured, commonly used, and machine-readable format, and transmit those data to another data controller without hindrance from the controller to whom the data were provided;
• The data subject has the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal effects or significantly affect them in a similar manner.
3. Security
Valérius-Têxteis, S.A. has implemented technical, operational, and organizational security standards through policies, procedures, and internal controls to protect personal data from loss, misuse, alteration, or destruction. Only authorized persons from Valérius-Têxteis, S.A. and our third-party service providers have access to personal data, with the obligation to treat such information as confidential. Despite these precautions, we cannot guarantee that unauthorized persons will not gain access to your personal data.
